Welcome to HealthDecoder! These Terms of Service ("Terms") govern your access to and use of the HealthDecoder mobile application and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using HealthDecoder, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or guardian's consent to use the Service.

2. Description of Service

HealthDecoder provides a platform for:

• Logging health-related events including food intake, glucose readings, insulin administration, activities, supplements, medications, and symptoms
• Voice and text input processing using AI technology
• Photo capture for food logging and barcode scanning
• Integration with third-party fitness trackers (Fitbit, WHOOP, Oura)
• Viewing and tracking your health history

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for safeguarding your account. Notify us immediately if you suspect unauthorized access to your account.

4. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Impersonate any person or entity
• Use the Service to collect information about other users
• Resell, redistribute, or commercialize the Service without authorization
• Use automated means to access the Service without permission

5. Third-Party Services

5.1 Fitness Tracker Integrations

If you connect third-party fitness trackers, your use of those services is governed by their respective terms of service:

5.2 AI Processing

We use Google's Gemini AI for voice and text processing. Your use of these features is subject to Google's Terms of Service.

6. Intellectual Property

6.1 Our Rights

The Service, including its design, features, content, and underlying technology, is owned by HealthDecoder and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

6.2 Your Content

You retain ownership of the health data and content you submit to the Service. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

7. Health Information Disclaimer

• The Service does NOT provide medical advice, diagnosis, or treatment
• AI-generated nutritional information may contain errors and should be verified
• Never disregard professional medical advice based on information from the Service
• Always consult healthcare professionals before making health-related decisions
• In case of medical emergency, call emergency services immediately

8. Disclaimer of Warranties

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will meet your specific requirements

9. Limitation of Liability

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless HealthDecoder and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your health-related decisions based on information from the Service

11. Modifications to Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

11.2 Terms Changes

We may update these Terms from time to time. Material changes will be communicated through the app or via email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the Service
• Is fraudulent or illegal

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

14. Dispute Resolution

Before filing any claim, you agree to first contact us and attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HealthDecoder regarding the Service and supersede any prior agreements.
